Services may be customized per project and detailed in a proposal or agreement between Creative Web Design and the client.
3. Client Responsibilities
Clients agree to:
- Provide all required content, logos, images, and materials in a timely manner.
- Cooperate throughout the development process (reviews, approvals, etc.).
- Ensure that all materials provided do not infringe on third-party rights or violate any laws.
- Make full and timely payment according to agreed terms.
Failure to cooperate or delays in providing requested materials may result in project delays or additional charges.
4. Quotations and Payments
- Quotes are valid for 14 days unless otherwise stated.
- A deposit (typically 50%) is required before work begins.
- Final balance is due upon completion, prior to the launch or delivery of final files.
- Payments are accepted via bank transfer, PayPal or other methods as specified.
Late Payments: A late fee may apply for overdue invoices. Creative Web Design reserves the right to pause or terminate services for non-payment.
5. Revisions and Approvals
- Each project includes a specified number of revisions
- Additional revisions beyond the included scope may incur extra charges.
- Final approval from the client is required before the website is published or handed over.
6. Turnaround Time
Turnaround times are estimated and depend on:
- The scope of work
- Prompt client feedback
- Timely delivery of required materials
Creative Web Design will not be liable for delays caused by circumstances beyond our control, including client inaction, third-party issues, or force majeure.
7. Intellectual Property
- Clients retain full ownership of the website and content upon full payment.
- Creative Web Design retains the right to display completed projects in our portfolio or marketing materials.
- Any third-party assets used (e.g., plugins, fonts, stock images) are subject to their respective licenses.
Custom design created by Creative Web Design remain the property of the agency until the project is paid in full.
8. Hosting and Domain
- Clients are responsible for securing their own hosting and domain unless arranged through us.
- If Creative Web Design manages hosting, we will act as a liaison with the hosting provider but are not liable for downtime, data loss, or technical issues caused by the provider.
9. Maintenance and Support
- Basic support is included during the launch period.
- Ongoing maintenance, backups, and updates are offered as part of a separate maintenance plan.
- Clients without a maintenance plan assume full responsibility for website updates, security, and backups.
10. Cancellation and Termination
- Either party may cancel the project in writing.
- If canceled by the client after the project has begun, the deposit is non-refundable.
- If canceled by Creative Web Design for breach of these terms, any completed work will be invoiced accordingly.
- We reserve the right to refuse or terminate service to anyone at our discretion.
11. Warranties and Disclaimers
- We strive to ensure all websites are functional, secure, and compatible with modern browsers.
- We do not guarantee specific search engine rankings, traffic increases, or third-party plugin performance.
- All services are provided “as is” without warranties of any kind, either express or implied.
12. Limitation of Liability
To the fullest extent permitted by law, Creative Web Design shall not be liable for:
- Loss of profits or revenue
- Business interruption
- Data loss or damage
- Security breaches caused by third parties
- Errors or issues resulting from client changes after delivery
Our total liability shall not exceed the amount paid for the specific service in question.
13. Confidentiality
Both parties agree to keep all sensitive project-related information confidential unless required by law or with express permission.
15. Changes to Terms
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services indicates acceptance of the revised terms.
